    Our mission is to develop an app, which changes the idea of typical social networking. Social networking has been used to connect with friends or family and has continuously taken the right steps forward. We want to take social networking even further and create an app specifically for those to connect with one another all over the world that may deal with mental, physical, or other challenges; this app is called Journey. We believe this app will give people the opportunity to share their story, give advice, seek advice, learn and educate daily in this global community that will enrich their lives and those others with their own conquests, challenges and struggles. We know that the app will involve people that are dealing with different situations such as Breast Cancer, Autism, ALS, and more. We want to create the ability for those to stand out and not only have them learn from others that are dealing with similar situations; but to learn, educate, encourage, and inspire others to continue to work hard and make any dream come true!

    Taylor and Loren have been best friends for 8 years and running. They both have the determination and will to

    not only help others, but also make this world into a better place. With both earning Bachelor Degrees, Taylor at University of Nebraska-Lincoln and Loren at California State-San Bernardino, they are now focused on working together on creating a difference in society. Even though Taylor participated in football for four years as the starting quarterback of his college, his extra-curricular activities included participating in different organizations to help those suffering from Chronic illnesses; being an inspiration to those as proving them that dreams can come true. Loren's ability to encourage others continued to develop as he worked as a Personal Trainer during his years of college; aiding those that deal with different situations such as training clients that are paralyzed waist down, as well as training individuals that are Autistic. They both WILL live a life of inspiration and encouragement as they live their journey.

Our Application (hereinafter referred to as “We”, “Us” or “Our”) is committed to maintaining your confidence and trust with respect to any information, recorded in any form, about an identified individual, or an individual whose identity may be inferred from the information. This includes, for example, name, e-mail, User name, password and other information incidental to providing the services offered on our application (“Personal Information”).

    Individuals accessing the application shall be referred to as “You” “Your” or “Users”. Services offered to Users are collectively referred to herein as the “Service” or “Services”. We intend to protect the Personal Information stored on the application and this privacy statement describes how we intend to do that.


    If you do not agree with these terms, do not provide any Personal Information to us. If you refuse or withdraw your consent, or if you choose not to provide us with any required Personal Information, we may not be able to provide you with products or services that can be offered on our application.

    The following privacy statement explains our general policy and practices on safeguarding the data collected, processed, provided or transferred directly or indirectly by our clients in any form or manner.


    1.1 This application is an open platform that allows users to communicate with each other. We collect some information in order for you to have an account you can use to access the services on our application, and other information that is necessary to make the service work.

    1.2 We do take efforts to make sure the platform keeps working. This includes using your information, where necessary, to stop spam and gaming and other activities that violate the user agreement.     2.1 Registration information: When you create an account, you are required to provide a username and password, category, photograph, your gender, age and may opt to provide an email address. We also log, and retain indefinitely, the IP address from which the account is initially created.

    2.2 Messages/texts/comments/posts: The posts and comments you make on our application are not private, not readily accessible to the public. This means that, by default, they are not deleted from our servers ever and will still be accessible after your account is deleted. However, we only save the most recent version of comments and posts, so your previous edits, once overwritten, are no longer available.

    2.3 Your messages are generally only viewable by the parties involved, but they may be accessed internally as needed for community support. Moreover, we keep a complete log of all messages sent on our service, even when both parties later delete their accounts.

    2.4 Journey stores the IP addresses associated with specific posts, comments, and private messages for 90 days after they are made or sent.

    2.5 Communications you send to us (for example, when you ask for support, send us questions or comments, or report a problem).

    2.6 Log data is certain information that is automatically collected by our systems when you visit this application, including the type of software used to access the application (browser, operating system), the type of device you are using, the address of the external or internal page that referred you, and your IP address. This information is recorded for all visitors and is only linked to your account if you are signed in. Except for the IP address you use to create the account, all IP addresses will be deleted from our servers after 90 days.

    2.7 We collect information about how all visitors browse the application to make Journey better. We remove personally identifiable data from this information after 90 days.

    2.8 When you are logged into your application account, we save the following information about your preferences and your interactions with the application to allow you to customize your experience such as subscriptions, preferred language, all languages you see content in and date of last login.


    3.1 We use the personal information you submit to operate, maintain, and provide to you the features and functionality of the Service.

    3.2 By providing us your email address you consent to our using the email address to send you Service-related notices, including any notices required by law, in lieu of communication by postal mail. You may not opt out of some Service-related communications. We may also use your email address to send you other messages, including changes to features of the Service and special offers. If you do not want to receive such email messages, you may opt out at any time by clicking “Unsubscribe” in any e-mail we send you. If you e-mail us directly, we may e-mail you back and keep records of all of our correspondence.

    3.3 Opting out may prevent you from receiving email messages regarding updates, improvements, or offers.

    3.4 We may use certain information about you and/or your User Content. We do this for purposes such as analyzing how the Service is used, diagnosing service or technical problems, maintaining security, and personalizing advertisements and promotions.


    4.1 It takes a lot of work to keep our application running and prevent abuse, and we sometimes use your data in order to facilitate this. Your information is used internally only where necessary to provide our services. For instance, we keep IP addresses for 90 days in order to investigate issues with our application, track and block suspected spammers, and otherwise maintain the integrity of the community.

    4.2 Your personal information is never for sale. We will only share your personal data with your consent, and after letting you know what information will be shared and with whom, unless it is otherwise permitted in this policy.

    4.3 We may disclose or preserve for future disclosure, your information if we believe, after due consideration, that doing so is reasonably necessary to comply with a law, regulation, or valid legal process. If we are going to release your information, we will do our best to provide you with notice in advance via our application’s private messaging system unless we are prohibited by court order from doing so (e.g., an order under 18 U.S.C. § 2705(b)). We reserve the right to delay notice to users in cases involving the exploitation of minors and when we believe a delay is necessary to prevent imminent and serious bodily harm to a person.

    4.4 As we develop our business, we may buy or sell assets or business offerings. Customer, email, and visitor information is generally one of the transferred business assets in these types of transactions. We may also transfer such information in the course of corporate divestitures, mergers, or dissolution. 

    4.5 We may share your personal information with business partners who assist us by performing services such as hosting, fulfillment, or data storage and security related to our operation of the application. If you have submitted personal information through our application and would like that information deleted from our records or would like to update or correct that information, use our Contact Us page.

    7.4 We may serve third-party advertisements that use cookies and web beacons in the course of ads being served on our application to ascertain how many times you've seen an advertisement. No personally identifiable information you give us is provided to them for cookie or web beacon use, so they cannot personally identify you with that information on our application.

    7.5 We use a tool called Google Analytics to help us understand how users interact with our application. It tells us aggregate usage and traffic information, such as how the application was accessed, how long visitors stayed, and the number of first-time visitors to the application.     9. AGE:

    Although we welcome users from all walks of life, Journey is not aimed at children, and the United States government has put limits on our ability to accept users under a certain age through the Children's Online Privacy Protection Act of 1998. Individuals under the age of 13 may not create an account with us. If you believe someone 12 or younger is using our application without parental consent, please contact us.


    10.1 The application has links to other websites whose privacy practices may differ from Our Privacy Policy. If you allow another website to access your information and to store a copy of your personal information, that copy will be governed by that website’s privacy policy. If you submit personal information to any of those sites, the privacy and security of your personal information is subject to their privacy statements. We are not responsible for the content, performance, or privacy policies of third-party websites. We encourage you to carefully read the privacy statement of any other website you visit.

    10.2 You will find various links on our application, including but not limited to search results and sponsored results. These sites are owned and maintained by independent companies, over which we have no control, and who are not covered by this privacy policy. We are not liable or responsible for the content of these sites, or their collection of information and its use. Please note that this privacy policy applies only to this application.

    11. OPT OUT:

    While we have very high standards for the types of ads we show, we also want to make it easy for you to opt out of sending your device's unique advertising identifier to us. In order to opt out you shall click on the Opt Out option.


    12.1 With your permission, Location Services allows apps and websites (including Maps, Camera, Weather, and other apps) to use information from cellular, Wi-Fi, Global Positioning System (GPS) networks, and Bluetooth to determine your approximate location. For example, an app might use your location and your recent location searches to help you find nearby coffee shops, theaters, and restaurants. Another app might use your location data to provide a list of popular apps in your immediate area. You must enable Location Services on your device and give your permission to each app or website before it can use your location data. If you turn off Location Services and then use Find My iPhone Lost Mode, your device will turn on Location Services for as long as the device is in Lost Mode. When you turn off Lost Mode, Location Services will return to its previous state.

    12.2 The first time an app tries to access your location, even in the background, it will ask for your permission. You'll see which app is asking for permission to use your location, and the app's developer may also explain how their app uses your location.

    12.3 You can turn Location Services on or off at Settings > Privacy > Location Services. You can turn Location Services on either during the Setup Assistant process or later through the Location Services setting. You can individually control which apps and system services have access to Location Services data. When Location Services are off, apps can't use your location in the foreground or background. This will limit the performance of various Apple and third-party apps.


    If you delete a Journey app from your mobile device, any app-specific information stored on your device will be deleted from your device. If you have backed up your device’s apps, Journey app information may continue to exist where you have backed it up. Any information collected by a Journey app while you are signed in to your Journey account is retained as described in the What Information We Collect section of this policy.


    By using the application, you agree that this Privacy Policy is governed by laws of United States and that any and all controversies arising under this Privacy Policy shall be resolved exclusively by the courts located in California, United States.


    15.1 Journey is headquartered in California, United States. Any request or demand from any government to deliver user data will be thoroughly checked by our lawyers, and we will not comply unless the law that actually applies to us would undeniably require it from us. And even in that hypothetical situation, we would refer to the fact we have no personal user data to share

    15.2 The only legitimate way that we see to make us start collecting personal information, is if there is a valid warrant or court order, obliging us to do so in relation to a specific user because that person is suspected to have committed a crime which is serious enough to warrant such a restriction of privacy.

    16. Newsletter/Unsubscribe Newsletter: By you signing up onto Journey - A positive social network and agreeing to the Terms Of Service and Privacy Policy, you have subscribed to the newsletter that will get sent to your email address that you signed up with. You may receive this at anytime. If you do not want to receive the email anymore you can click "Unsubscribe" on the email when you receive it and it will take you off the list.

    This mobile application named Journey (hereinafter referred to as "Journey", “application”, "we", "our" or "us") is a place where either peoplesuffering from a disease (as stated in the category column during the registration process)or people registering as a supporter in the category sectioncome to connect, discover, and share. Journey gives all its users, access to a massive platform where users can interact with one another. Through an open design, compelling features, and analytics-based recommendations, Journey fosters a creative community of people who connect around mutual affinity and inspiration for the purpose of shaping, sharing, and discovering ideas etc.

    The “Journey” Services are operated by Journey Inc., a Corporation having an address at 565 Jackson St. Colton California-92324.

    This Agreement constitutes legally binding terms and applies to such use of the Journey Services only on apple I phones and I pads. By accessing and/or using any of the Journey Services, you agree to be bound by this Agreement. You are authorized to use the Journey Services (regardless of whether your access or use is intended) only if you agree to abide by all applicable laws, rules and regulations ("Applicable Law") and the terms of this Agreement. In addition, in consideration for becoming a Member and/or making use of the Journey Services, you must indicate your acceptance of this Agreement during the registration process. Thereafter, you may create your account (your "Account"), and its associated profile(s) (each a "Profile") in accordance with the terms herein.

    Your continued use of the Journey Services constitutes your agreement to be bound by and your acceptance of the terms and conditions posted at such time, and will be a new agreement between us applicable to such new use or transaction. IF YOU ARE NOT A RESIDENT OF UNITED STATES, BY SUBMITTING YOUR PERSONALLY IDENTIFIABLE INFORMATION ON THE APP, YOU CONSENT TO THE TRANSFER OF SUCH DATA TO UNITED STATES, AND TO THE PROCESSING OF SUCH DATA ON OUR SERVERS, WHERE YOUR DATA WILL BE GOVERNED BY THE LAWS OF UNITED STATES THAT MAY PROVIDE A LEVEL OF DATA PROTECTION DIFFERENT THAN YOUR COUNTRY.

    Your use of application Services, features, functionality or programs offered on or through the application may be subject to additional terms and conditions ("Special Rules"), and before you use any such services, features, functionality or other programs you may be required to indicate your acceptance of such additional Special Rules. All Special Rules are incorporated into these TOS as if fully set forth herein.

    These terms and conditions apply to all users of the Services, including, without limitation, users who are contributors of content, photos, information, and other materials or services, registered or otherwise.


    1.1 Journey is a social networking application which can be used only on apple I Phones and I pads.

    1.2 This application is for people who can register either by choosing a disease they are suffering from listed in the category sectionor for people who want to register on the application as a supporter by choosing supporter in the category section in order to interact with one another.

    1.3 People who are suffering from some or the other disease listed in the category section and people registered on the application as supporters can chat or interact with each other through messages/texts etc. The users of this application can also share their photos etc with their friends.

    1.4 This application is a great way to connect and meet new friends. Once you register as a user then you can invite your contacts or invite Facebook friends to join your journey.


    Use of the Journey Services and registration to be a Member for the Journey Services ("Membership") is void where prohibited and subject to compliance with Applicable Law, this Agreement and any applicable Additional Terms. By using the Journey Services, you represent and warrant that (a) all registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are 13 years of age or older, and if you are not of the age of majority where you reside, you will only use the Journey Services with parental or legal guardian consent (following their review of this Agreement); and (d) your use of the Journey Services does not violate any Applicable Law. You may not create an Account for anyone other than yourself without the other person's permission. Your Account will be deleted and your Membership may be terminated without warning, if we believe that you have misrepresented your age or identity to us in a manner that violates this Agreement or is unlawful. Registered sex offenders and those convicted of violent crimes are not eligible for Membership.


    3.1 When creating or registering an Account on the application, you are required to provide us with certain personal information such as your email address, user name, password, profile photo and category (i.e. the disease you are suffering from or as a supporter) phone number (optional). You shall also select your gender and age during the sign up process.You agree that you will supply accurate and complete information to us when requested, and that you will update that information promptly after it changes.

    3.2 Once you register with us, you become a member of our application. Registering an account on our application is free.

    3.3Username and Password: During the Account creation process, you may be required to select a unique username and/or a password (collectively referred to hereunder as “Login Information”), and you may not share the Account or the Login Information with anyone other than as expressly set forth herein.You are responsible for maintaining the confidentiality of the Login Information, and you will be responsible for all uses of the Login Information, including use of the application, whether or not authorized by you. In the event you become aware of or reasonably suspect any breach of security, including without limitation any loss, theft, or unauthorized disclosure of the Login Information, you must immediately notify us by emailing at JourneyAppStore@gmail.com .


    4.1 The personal information you submit to Journey App is governed by the Journey App Privacy Policy. To the extent there is an inconsistency between this Agreement and the Journey App Privacy Policy, this Agreement shall govern.

    4.2 The Journey app contains functionality (including blogs, message boards, user reviews of drug information, medical images and etc.) that allows users to upload content to the Journey app (collectively "Public Areas"). You agree that you will not upload or transmit any communications or content of any type to the Public Areas that infringe or violate any rights of any party. By submitting communications or content to the Public Areas, you agree that such submission is non-confidential for all purposes.

    4.3 If you make any such submission you agree that you will not send or transmit to Journey App by email, (including through the email addresses listed on the "Contact Us" page) any communication or content that infringes or violates any rights of any party. If you submit any business information, idea, concept or invention to Journey App by email, you agree such submission is non-confidential for all purposes.

    4.4 If you make any submission to a Public Area or if you submit any business information, idea, concept or invention to Journey App by email, you automatically grant-or warrant that the owner of such content or intellectual property has expressly granted-Journey App a royalty-free, perpetual, irrevocable, world-wide nonexclusive license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform, and display the communication or content in any media or medium, or any form, format, or forum now known or hereafter developed. Journey App may sublicense its rights through multiple tiers of sublicenses. If you wish to keep any business information, ideas, concepts or inventions private or proprietary, do not submit them to the Public Areas or to Journey App by email. We try to answer every email in a timely manner, but are not always able to do so.

    4.5 You agree to only post or upload Media (like photos) that you have taken yourself or that you have all rights to transmit and license and which do not violate trademark, copyright, privacy or any other rights of any other person. Photos or videos of celebrities and cartoon or comic images are usually copyrighted by the owner.

    4.6 To protect your privacy, you agree that you will not submit any media that contains Personally Identifiable Information (like name, phone number, email address or web site URL) of you or of anyone else. Uploading media like images of other people without their permission is strictly prohibited.

    4.7 By uploading any media on the Journey App, you warrant that you have permission from all persons appearing in your media for you to make this contribution and grant rights described herein. Never post a picture of or with someone else unless you have their explicit permission.

    4.8 It is strictly prohibited to upload media of any kind that contain expressions of hate, abuse, offensive images or conduct, obscenity, pornography, sexually explicit or any material that could give rise to any civil or criminal liability under applicable law or regulations or that otherwise may be in conflict with these Terms and Conditions, the  Journey App Privacy Policy and the Journey App Privacy Policy.

    4.9 You agree that you will not upload any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or this app.

    4.10 By uploading any media like a photo or (a) you grant to Journey App a perpetual, non-exclusive, worldwide, royalty-free license to use, copy, print, display, reproduce, modify, publish, post, transmit and distribute the media and any material included in the media; (b) you certify that any person pictured in the submitted media (or, if a minor, his/her parent/legal guardian) authorizes Journey App to use, copy, print, display, reproduce, modify, publish, post, transmit and distribute the media and any material included in such media; and (c) you agree to indemnify Journey App and its affiliates, directors, officers and employees and hold them harmless from any and all claims and expenses, including attorneys' fees, arising from the media and/or your failure to comply with these the terms described in this document.

    4.11 Journey App reserves the right to review all media prior to submission to the Journey app and to remove any media for any reason, at any time, without prior notice, at our sole discretion.


    5.1 The contents of the Journey App, such as text, graphics, images, information obtained from Journey's licensors, and other material contained on the Journey app ("Content") are for informational purposes only. The Content is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read on the Journey app.

    5.2 If you think you may have a medical emergency, call your doctor or 911 immediately. Journey app does not recommend or endorse any specific tests, physicians, products, procedures, opinions, or other information that may be mentioned on the journey app. Reliance on any information provided by Journey app , Journey app employees, others appearing on the Journey app at the invitation of Journey app, or other visitors to the Journey app is solely at your own risk.

    5.3 The Journey app may contain health- or medical-related materials that are sexually explicit. If you find these materials offensive, you may not want to use the Journey app.


    6.1 This Agreement (or if applicable, Other Agreement and/or Additional Terms), in the form posted at the time of your use of the applicable Journey Services to which it applies, shall govern such use of such Journey Services (including transactions entered during such use). As our services evolve, the terms and conditions under which we offer Journey Services may prospectively be modified and we may cease offering the Journey Services under the Agreement or Additional Terms for which they were previously offered. Accordingly, each time you sign in to or otherwise use the Journey Services you are entering into a new agreement with us on the then applicable terms and conditions and you agree that we may notify you of Other Terms by posting them on the applicable Journey Services (or in any other reasonable manner of notice which we elect), and that your use of such Journey Services after such notice constitutes your going forward agreement to the Other Terms for your new use and transactions. Therefore, you should review the posted Agreement and any applicable Additional Terms each time you use the Journey Services (at least prior to each transaction or submission). The Other Terms will be effective as to new use and transactions as of the time that we post them, or such later date as may be specified in them or in other notice to you. However, the Agreement (and any applicable Additional Terms) that applied when you previously used the Journey Services will continue to apply to such prior use (i.e., changes and additions are prospective only) unless mutually agreed. You should frequently check the application, any Messages sent from Journey to you on the application, and the e-mail you associated with your Account for notices, all of which you agree are reasonable manners of providing you notice. You can reject any new, revised or additional terms by discontinuing use of the Journey Services.

    6.2 You may terminate your Membership at any time, for any reason, by following the instructions in your Profile Settings. We may terminate your Membership at any time, for any or no reason, with or without prior notice or explanation, and without liability, except that you may have certain refund rights as provided in the next section. Further, we may deny, restrict, suspend, or terminate your access to all or any part of the Services at any time, for any or no reason, with or without prior notice or explanation, and to the maximum extent permitted by applicable law, without liability, except that you may have certain refund rights as provided in the next section.

    6.3 In addition, Journey reserves the right, in its sole discretion, to reassign or rename your username and/or Profile URL and to allow indexing of such URL by third party search engines. Journey expressly reserves the right to remove your Profile or Content, in whole or in part, and/or deny, restrict, suspend, or terminate your access to all or any part of the Services, if Journey determines, in its sole discretion, that you have violated this Agreement, are acting in a manner we deem inappropriate for the Services, or pose a threat to us, our employees, business partners, Users and/or the public. Even after Membership is terminated, or you cease using our Services, some terms of your Agreement with us will remain in effect, except as may be mutually agreed (e.g., acceptance of Other Terms).

    7. CONTENT:

    7.1 Definition: For purposes of these terms of use, the term "Content" includes, without limitation, messages, photos, information, articles, blogs, discussions, data, text, written posts, media and news, comments, feedback, software, scripts, graphics, and interactive features generated, provided, or otherwise made accessible on or through the Services. For the purposes of these terms of use, "Content" also includes all User Content (as defined below).

    7.2 User Content: All Content added, created, uploaded, submitted, distributed, or posted to the Services by users (collectively "User Content"), publicly posted, is the sole responsibility of the person who originated such User Content. You represent that all User Content provided by you is accurate, complete, up-to-date, and in compliance with all applicable laws, rules and regulations. You acknowledge that all content, including User Content, accessed by you using the Services is at your own risk and you will be solely responsible for any damage or loss to you or any other party resulting there from. We do not guarantee that any Content you access on or through the Services is or will continue to be accurate.

    7.3 User content also includes discussions, conversations, question and answers and blogs/articles. Discussion is a traditional threaded discussion, where the replies are grouped by each topic raised. Everybody has the possibility to answer other contributors.


    All Journey Services are licensed to you and not sold. Subject to the terms of this agreement, Journey grants you a personal, non- exclusive, non-transferable and non-sublicensable license to use our Services solely for your personal or internal purposes. By submitting User Content through the Services, you hereby do and shall grant us a worldwide, non-exclusive, perpetual, royalty-free, fully paid, sub-licensable and transferable license to use, edit, modify, truncate, aggregate, reproduce, distribute, prepare derivative works of, display, perform, and otherwise fully exploit the User Content in connection with theapplication, the Services and our (and our successors' and assigns') businesses, including without limitation for promoting and redistributing part or all of the Services (and derivative works thereof) in any media formats and through any media channels (including, without limitation, third party websites and feeds), and including after your termination of the Services. For the sake of clarity, the foregoing license grant includes our right to distribute, display, perform and otherwise use the User Content in connection with material provided by our sponsors, and you shall not be entitled to any remuneration for such use. To the extent any User Content you submit includes your name, likeness, voice, or photograph, you acknowledge and agree that the foregoing license of this Section shall apply to the same. You also hereby do and shall grant each user of the Services a non-exclusive, perpetual license to access your User Content through the Services, and to use, edit, modify, reproduce, distribute, prepare derivative works of, display and perform such User Content, including after your termination of your Account or the Services. For clarity, the foregoing license grants to us and our users do not affect your other ownership or license rights in your User Content, including the right to grant additional licenses to your User Content, unless otherwise agreed in writing. You represent and warrant that you have all rights to grant such licenses to us without infringement or violation of any third party rights, including without limitation, any privacy rights, publicity rights, copyrights, trademarks, contract rights, or any other intellectual property or proprietary rights.


    We have not reviewed, and cannot review, all of the material, including computer software, posted to the application, and cannot therefore be responsible for that material’s content, use or effects. By operating the application, we do not represent or imply that it endorses the material there posted, or that it believes such material to be accurate, useful or non-harmful. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. The application may contain content that is offensive, indecent, or otherwise objectionable, as well as content containing technical inaccuracies, typographical mistakes, and other errors. The application may also contain material that violates the privacy or publicity rights, or infringes the intellectual property and other proprietary rights, of third parties, or the downloading, copying or use of which is subject to additional terms and conditions, stated or unstated. We disclaim any responsibility for any harm resulting from the use by visitors of the application, or from any downloading by those visitors of content there posted.


    10.1 Journey does not claim any ownership rights in the text, Messages, files, images, photos, or any other materials (collectively, "Content") that you transmit, submit, display or publish ("post") on, through or in connection with the Journey Services. After posting your Content on, through or in connection with our Services, you continue to retain any such rights that you may have in your Content, subject to the limited license granted in clause 6 of these terms of use. The license you grant is perpetual; provided, however, that after you remove your Content from our Services, we will make commercially reasonable efforts to remove such specific deleted Content from further distribution on our Services, as soon as practicable but, please be aware that any distribution of your Content that may have occurred by you or other Users via Linked Services, or otherwise (e.g., posted on third party User's Profiles, sent by you to other Users, contributed to a mashup of Content from multiple Users, etc.) may continue to be displayed, distributed and used. Further, deleted Content may persist in archival copies on our servers for a reasonable period of time. You understand and agree that once Content is distributed to a Linked Service, Journey is under no obligation to delete or ask other Users or a Linked Service to delete that Content; therefore, it may continue to appear and be used indefinitely.

    10.2 The license you grant to us is non-exclusive (meaning you are free to license your Content to anyone else in addition to Journey), fully-paid and royalty-free (meaning that Journey is not required to pay you or anyone else deriving rights from you for the use by Journey of the Content that you post), sublicensable (so that Journey is able to use its affiliates, subcontractors and other partners such as Internet content delivery networks and wireless carriers to provide our Services and, subject to good faith efforts to honor your Profile Settings, to third party search engines), and worldwide (because the Internet and our Services are global in reach). Except as prohibited by law, you hereby waive, and you agree to waive, any moral rights (including attribution and integrity) that you may have in any Content. To the extent not waivable, you irrevocably agree not to exercise such rights (if any) in a manner that interferes with any exercise of the rights granted hereunder. You understand that you will not receive any fees, sums, consideration, or remuneration for any of the rights granted. If you are a minor, you represent and warrant that your parent or legal guardian has consented to you granting the rights as set forth in this Section, or that are provided in any Additional Terms.

    10.3 Each time you submit any Content, you represent and warrant that you are at least the age of majority in the jurisdiction in which you reside or are the parent or legal guardian, or have all proper consents from the parent or legal guardian, of any minor (including yourself) who is depicted in or contributed to any Content you submit, and that, as to that Content: (i) you are the sole author and/or owner of the Content posted by you on, through or in connection with our Services, or otherwise have the lawful right to grant the license set forth in this Section or that is provided in any Additional Terms, all without any Journey obligation to obtain consent of any third party and without creating any obligation or liability of Journey, (ii) the Content is accurate; (iii) the posting of your Content on, through or in connection with our Services and/or Linked Services does not violate the privacy rights, publicity rights, intellectual property rights, contract rights or any other rights of any person or entity; and (iv) the Content will not violate this Agreement or any Additional Terms, or cause injury or harm to any person. You agree to pay all royalties, fees, and any other monies owing any person or entity by reason of the use of any Content posted by you on or through our Services.

    10.4 Except as otherwise described in the applicable Journey Services' posted Privacy Policy, or any Additional Terms, you agree that (a) your Content will be treated as non-confidential - regardless of whether you mark them "confidential," "proprietary," or the like - and will not be returned, and (b) Journey does not assume any obligation of any kind to you or any third party with respect to your Content. Upon our request, you will furnish us with any documentation necessary to substantiate the rights to such Content and to verify your compliance with this Agreement and any applicable Additional Terms.

    10.5 In your communications with Journey, please keep in mind that we do not seek any unsolicited ideas or materials for products or services, or even Journey improvements to products or services, such as ideas, concepts, inventions, or designs (collectively, "Unsolicited Ideas and Materials").

    10.6 The Journey Services contain Content owned by Journey ("Journey Content"). Journey Content is protected by copyright, trademark, patent, trade secret and other laws, and Journey owns and retains all rights in the Journey Content and the Journey Services. You acknowledge and agree that: (i) Journey owns all legal right, title and interest in and to the Services and to the Content created by Journey, including any intellectual property rights which subsist in the Services (whether those rights happen to be registered or not, and wherever in the world those rights might exist); and (ii) that Journey is in no way responsible for, nor shall have any liability related to, any Content which is not created by Journey. The trademarks, service marks, and trade names appearing on the application are the common law or registered trademarks of Journey. No trademark, service mark, or trade name may be used without the express written permission of the owner.


    Journey respects the intellectual property of others, and requires that our Users/Members do the same. You may not post, modify, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information belonging to others without obtaining the prior written consent of the owner of such proprietary rights. It is our policy to terminate Membership privileges of any Member who repeatedly infringes the copyright rights of others upon receipt of proper notification to us by the copyright owner or the copyright owner's legal agent. Without limiting the foregoing, if you believe that your work has been copied and posted on our Services in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information:

    (i) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;

    (ii) a description of the copyrighted work that you claim has been infringed;

    (iii) a description of where the material that you claim is infringing is located on our Services;

    (iv) your address, telephone number, and email address;

    (v) a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;

    (vi) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.     12.1 Please choose carefully the information that you post on, through or in connection with our Services and that you provide to other Users. If you become aware of misuse of our Services by any person or Linked Service, please visit our help page or, if available, click on the Profile, image, video, comment or other item to report the Content directly to our support team.

    12.2 We may reject, refuse to post or delete any Content that, in the sole judgment of Journey, violates this Agreement, is inappropriate for our Services or which may be offensive, illegal or violates the rights of any person or entity, or harms or threatens the safety of any person or entity. However, we are not obligated to take any action not required by law. Journey may, but assumes no responsibility or obligation for reviewing or monitoring the Journey Services for inappropriate Content or conduct. If at any time Journey chooses, in its sole discretion, to review or monitor the Journey Services, Journey nonetheless assumes no responsibility for the Content, no obligation to modify or remove any inappropriate Content, and no responsibility for the conduct of the User submitting any such Content.

    12.3 You are solely responsible for the Content that you post on, through or in connection with any of our Services and/or Linked Services, and any material or information that you transmit to other Members and for your interactions with other Users. Any breach by you of this Section will be subject to the indemnification obligations.

    12.4 The Journey Services are a community and inherently a social network experience. Subject to our good faith efforts to honor your election of certain options we may offer from time to time that may offer you certain choices regarding what is shared and with whom, your activities, Content and Content consumption may be viewable by, or shared with, others on and off of our Services, including advertisers. You consent to this, and irrevocably grant us the sublicensable right to use and exploit your name, persona, likeness, pseudonym, Profile picture, information and Content, and to share it with others, without any obligation or remuneration to you.


    13.1 The following is a partial list of the kind of Content that is illegal or prohibited to post on or through our Services. We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision, including without limitation, removing the offending content from our Services and terminating the use of such violators. Prohibited Content includes, but is not limited to content that, in our sole discretion:

    a) is patently offensive and promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;

    b) harasses or advocates harassment of another person;

    c) exploits people in a sexual or violent manner;

    d) contains nudity, violence, or offensive subject matter or contains a link to an adult website;

    e) solicits personal information from anyone under 18;

    f) provides any telephone numbers, street addresses, last names, URLs or email addresses;

    g) promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;

    h) promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;

    h) involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing, instant messaging, "spimming," or "spamming";

    i) contains restricted or password only access pages or hidden pages or images (those not linked to or from another accessible page);

    j) furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;

    k) solicits passwords or personal identifying information for commercial or unlawful purposes from other Users;

    l) involves commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes;

    m) includes a photograph of another person that you have posted without that person's consent; orfor band and filmmaker profiles, uses sexually suggestive imagery or any other unfair, misleading or deceptive Content intended to draw traffic to the profile.

    13.2 We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision, including without limitation, reporting you to law enforcement authorities. Prohibited activity includes, but is not limited to:

    a) criminal or tortious activity, including child pornography, fraud, trafficking in obscene material, drug dealing, gambling, harassment, stalking, spamming, spimming, sending of viruses or other harmful files, copyright infringement, patent infringement, or theft of TRADE secrets;

    b) advertising to, or solicitation of, any Member to buy or sell any services through our Services. You may not transmit any chain letters or junk email to other Members. It is also a violation of these rules to use any information obtained from the our Services in order to contact, advertise to, solicit, or sell to any Member without their prior explicit consent;

    c) covering or obscuring the banner advertisements on your personal profile page, or any of our page via HTML/CSS or any other means;

    d) any automated use of the system, such as using scripts to add friends or send comments or messages;

    e) interfering with, disrupting, or creating an undue burden on our Services or the networks or services connected to our Services;

    f) attempting to impersonate another Member or person;

    g) using the account, username, or password of another Member at any time or disclosing your password to any third party or permitting any third party to access your account;

    h) using any information obtained from our Services in order to harass, abuse, or harm another person;

    i) displaying an advertisement on your profile, or accepting payment or anything of value from a third person in exchange for your performing any commercial activity on or through our Services on behalf of that person, such as placing commercial content on your profile, posting blogs or bulletins with a commercial purpose, selecting a profile with a commercial purpose as one of your list of friends, or sending private messages with a commercial purpose; or

    j) using our Services in a manner inconsistent with any and all applicable laws and regulations.


    You are solely responsible for your interactions with other Members on Our application. We reserve the right, but have no obligation, to monitor disputes between you and other members.


    15.1 Journey performs technical functions it deems necessary or appropriate to offer the Services, including, but not limited to, the technical processing and transmission of Messages to perform the messaging service, and transcoding and/or reformatting Content to allow its use throughout our Services. In addition, you agree and acknowledge that we may send Messages, whose content may include, but not be limited to, notifications, special offers, promotions, commercial advertisements, and marketing materials, in connection with our Services. We offer you certain choices as to what type of commercial communications you receive from our Services, which you can exercise by visiting your Settings for notifications, or by following the unsubscribe instructions contained at the bottom of commercial emails sent by us, and we will make good faith efforts to honor those choices. However, regardless of your elections we reserve the right to contact you to address transactional and operational issues related to your Account, Membership or activities in connection with our Services.

    15.2 When you communicate with us electronically, such as via e-mail and text message, you consent to receive communications from us by the same method. Please note that we are not obligated to respond to inquiries that we receive. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

    15.3 Journey may interact with law enforcement regarding your use of our Services. You acknowledge and agree that Journey may make your information available to law enforcement.


    Our application is free on Apple known as the App Store. We, at no point of time, recommend or support any other application hosted on these websites. We do not transact with our customers directly and any in-app purchase will only be through these stores.


    We allow you to buy extra and premium features in our app. You can and should buy the extra features as and when required in order to use the app to its fullest extent possible. There is No-Refund on purchasing the In-App purchase. Once you have bought it, YOU WILL NOT GET YOUR MONEY BACK. If there is an issue with the bill, please contact apple support and let them know what happened. We shall not be held liable for any payment issues or disputes with iTunes related to Apple App Store, In-App Purchases. iTunes payment terms shall be followed for the subscription and payment.


    User can create a private account in order to make their posts, texts etc. Private so that only the selected people can see them. In order to create a private account, you shall at the time of creating an account select private in the privacy settings menu i.e. turn on the private account setting by going on to the settings section.




    WE ALSO RESERVE THE RIGHT, AT ALL TIMES AND IN OUR SOLE DISCRETION, TO DISCLOSE ANY USER CONTENT AND OTHER INFORMATION (INCLUDING WITHOUT LIMITATION CHAT TEXT, VOICE COMMUNICATIONS, IP ADDRESSES, AND YOUR PERSONAL INFORMATION) FOR ANY REASON, including without limitation (a) to satisfy any applicable law, regulation, legal process or governmental request; (b) to enforce the terms of this Agreement or any other policy; (c) to protect our legal rights and remedies; (d) to protect the health or safety of anyone we believe may be threatened; or (e) to report a crime or other offensive behavior.


    The Services may permit you to link to other websites, services or resources on the Internet, including but not limited to our sponsors, and other websites, services or resources may contain links to the Services. When you access third party resources on the Internet, you do so at your own risk. These other resources are not under our control, and you acknowledge that we are not responsible or liable for the content, functions, accuracy, legality, appropriateness or any other aspect of such websites or resources. The inclusion of any such link does not imply our endorsement or any association between us and their operators. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such website or resource.


    21.1 We have no special relationship with or fiduciary duty to you. You acknowledge that we have no duty to take any action regarding:

    a) which users gain access to the Services;

    b) what Content you access via the Services; or

    c) how you may interpret or use the Content.

    21.2 You release us from all liability for you having acquired or not acquired Content through the Services. We make no representations concerning any Content contained in or accessed through the Services, and we will not be responsible or liable for the accuracy, copyright compliance, or legality of material or Content contained in or accessed through the Services.



    You shall defend, indemnify, and hold harmless us, our affiliates and each of our respective employees, contractors, directors, suppliers and representatives from all liabilities, claims, and expenses, including reasonable attorneys' fees, that arise from or relate to your use or misuse of, or access to, the Services, Content, or otherwise from your User Content, violation of these terms of use, or infringement by you, or any third party using your identity in the Services, of any intellectual property or other right of any person or entity. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will assist and cooperate with us in asserting any available defenses.


    23.1 The Journey app and the content are provided on an "as is" basis. JOURNEY, ITS LICENSORS, AND ITS SUPPLIERS, TO THE FULLEST EXTENT PERMITTED BY LAW, DISCLAIM ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OF THIRD PARTIES' RIGHTS, AND FITNESS FOR PARTICULAR PURPOSE. Without limiting the foregoing, Journey app, its licensors, and its suppliers make no representations or warranties about the following:

    a) The accuracy, reliability, completeness, currentness, or timeliness of the Content, software, text, graphics, links, or communications provided on or through the use of the Journey app.

    b) The satisfaction of any government regulations requiring disclosure of information on prescription drug products or the approval or compliance of any software tools with regard to the Content contained on the Journey app.

    These terms of use shall be governed by and construed in accordance with the laws of United States. You agree that any dispute arising from or relating to the subject matter of this User Agreement shall be governed by the exclusive jurisdiction and venue of the courts of California, United States.


    25.1 Except as may otherwise be provided below or in a signed agreement between you and Journey, the sole and exclusive forum and remedy for any and all disputes and claims relating in any way to or arising out of this agreement or your access of the services shall be final and binding arbitration, except that: (a) to the extent that either of You or this application has in any manner infringed upon or violated or threatened to infringe upon or violate the other party's patent, copyright, trademark or trade secret rights, or you have otherwise violated the code set forth above, then you and this application acknowledge that arbitration is not an adequate remedy at law and that injunctive or other appropriate relief may be sought; and (b) no disputes or claims relating to any transactions you enter into with a third party through the application may be arbitrated.

    25.2 The location of the arbitration shall be in California, United States and the allocation of costs and fees for such arbitration shall be determined in accordance with the applicable Rules and shall be subject to the applicable limitations. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction.

    26. PRIVACY:

    26.1 We work hard to protect our users from unauthorized access to or unauthorized alteration, disclosure or destruction of information we hold however no application is entirely secure. You should protect the account information in your possession as well.

    26.2 Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time. Thus we cannot guarantee security completely. We otherwise store all of our information, including your IP address information, using techniques reasonably designed to secure the information. We do not guarantee or warrant that such techniques will prevent unauthorized access to information about you that we store, personal information or otherwise.

    27. GENERAL:

    27.1 Assignment: We may assign this Agreement, in whole or in part, to any person or entity at any time with or without your consent. You may not assign these TOU without our prior written consent, and any unauthorized assignment by you shall be null and void.

    27.2 Foreign jurisdiction: Our services are available globally. By agreeing to our terms of use, you warrant that it is completely legal to use our services and application in your country. It is the duty of the user to verify any potential violation. The user agrees to indemnify us, associated or sister companies, employees, agents or any related individual or organization for any liability it might incur in a foreign jurisdiction. Our services shall not be deemed to constitute an offer to sell or serve in countries where it is illegal to do so.

    27.3 Severability: If any part of this Agreement is determined to be invalid or unenforceable, then that portion shall be severed, and the remainder of this Agreement shall be given full force and effect.

    27.4 Attorneys’ Fees: In the event any litigation is brought by either party in connection with these TOU, the prevailing party in such litigation shall be entitled to recover from the other party all the reasonable costs, attorneys’ fees and other expenses incurred by such prevailing party in the litigation.

    27.5 No Waiver: Our failure to enforce any provision of this Agreement shall in no way be construed to be a present or future waiver of such provision, nor in any way affect the right of any party to enforce each and every such provision thereafter. The express waiver by us of any provision, condition or requirement of this Agreement shall not constitute a waiver of any future obligation to comply with such provision, condition or requirement.

    27.6 Notices: All notices given by you or required under this Agreement shall be in writing and addressed to: Help@PostYourJourney.com 

    27.7 Equitable Remedies: You hereby agree that we would be irreparably damaged if the terms of this Agreement were not specifically enforced, and therefore you agree that we shall be entitled, without bond, other security, or proof of damages, to appropriate equitable remedies with respect to breaches of these TOU, in addition to such other remedies as we may otherwise have available to it under applicable laws.

    27.8 Force Majeure: We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including without limitation, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor or materials.

    27.9 Newsletter/Unsubscribe Newsletter: By you signing up onto Journey - A positive social network and agreeing to the Terms Of Service and Privacy Policy, you have subscribed to the newsletter that will get sent to your email address that you signed up with. You may receive this at anytime. If you do not want to receive the email anymore you can click "Unsubscribe" on the email when you receive it and it will take you off the list.


    This Agreement, including the documents expressly incorporated by reference herein, constitutes the entire agreement between you and us with respect to the Service and supersedes all prior or contemporaneous communications, whether electronic, oral or written, between you and us with respect to the Services.

    You acknowledge and agree that: (a) you have read and understood the Terms; (b) the Terms are fair, reasonable, and not unduly restrictive; and (c) you have had the opportunity to confer with legal counsel of your choice prior to agreeing to the Terms.
